The Constitution of Independence is a contribution to the newly rejuvenated subject of comparative Commonwealth constitutional law, politics, and history. In Australia, Canada, and New Zealand, a series of fascinating developments have been under way for more than a decade, characterized by independent thinking, experimentation, and cross-Commonwealth borrowing of constitutional ideas. These include the final termination of constitutional ties with the United Kingdom Parliament and the emergence of controversial issues including variably entrenched or implied rights and freedoms; wide-ranging claims by (...) indigenous peoples; republicanism; and assertions of national, popular, and sectional sovereignty.This book explores the development of constitutional thinking in Australia, Canada, and New Zealand from early domination by Imperial ideas, through the adoption of the Statute of Westminster and the contemplation of severing Imperial connections, to irreversible acquisition of constitutional independence in the 1980s. This book focusses primarily on sovereignty and the legal system, concepts which are also central to contemporary constitutional theory in Europe and the United States. The book closes with an evaluation of recent varied and often contradictory accounts of the constitutional foundations of Australia, Canada, and New Zealand, which depict a wide range of scenarios: from constitutional continuity and respect for the rule of law, to popular sovereignty and disguised revolution. The ramified legacy of Bernard Berenson’s writings within 20th century art historiography is both celebrated and maligned. In an effort to help reconcile this situation, this essay argues for the partial validity of Berenson’s peculiar version of art historical formalism by detailing its historical connections to the Pragmatist philosophy and psychology of William James and by analytically correlating Berenson’s arguments with recent work in aesthetics and the philosophy of perception. The essay examines the specific example of Berenson’s analysis of Giotto’s (...) paintings and leverages a Pragmatist interpretation of Berenson’s writings to frame Berenson’s known connections with other writers: including Adolf Hildebrand, Giovanni Morelli, and Walter Pater. In conclusion, the failure, potential, reception, and legacy of Berenson’s art historical scholarship are assessed in relation to Pragmatist ideas. Der vielfältige Einfluss von Bernard Berensons Schriften auf die Kunstgeschichte des 20. Jahrhunderts wird ebenso geschätzt wie verachtet. In this introduction I closely read Marquand’s arguments in “On Scientific Method in the Study of Art” both in relation to their sources and in relation to Marquand’s own subsequent scholarship. My thesis is that Charles Sanders Peirce’s writing is the most conspicuous and important inspiration for the essay; however I also contend that Marquand’s handwritten corrections to the surviving manuscript of the text reveal a struggle with Peirce’s ideas that can – especially in light of Marquand’s later writing – (...) be read to expose an ambivalent or potentially even critical attitude toward central aspects of Peirce’s thought. I conclude by noting that Marquand’s intellectual relationship with Peirce speaks to both the past, present, and future of art historical scholarship. (shrink)

However, a complex parametrization provides a valuable way to describe amplitude and phase of a coherent beam. Thus we pose the question of whether a fermionic beam can be described, even approximately, by a complex-parametrized coherent state and define, in a natural way, approximate complex-parametrized fermion coherent states. Then we identify four appealing properties of boson coherent states (eigenstate (...) of annihilation operator, displaced vacuum state, preservation of product states under linear coupling, and factorization of correlators) and show that these approximate complex fermion coherent states fail all four criteria. Philosophy in the English-speaking world is dominated by analytic approaches to its problems and projects; but theology has been dominated by alternative approaches. Many would say that the current state in theology is not mere historical accident, but is, rather, how things ought to be. On the other hand, many others would say precisely the opposite: that theology as a discipline has been beguiled and taken captive by 'continental' approaches, and that the effects on the discipline have been largely deleterious. (...) The methodological divide between systematic theologians and analytic philosophers of religion is ripe for exploration. The present volume represents an attempt to begin a much-needed interdisciplinary conversation about the value of analytic philosophical approaches to theological topics. Most of the essays herein are sympathetic toward the enterprise the editors are calling analytic theology; but, with an eye toward balance, the volume also includes essays and an introduction that try to offer more critical perspectives on analytic theology. Competence to enact responsible practices, such as recycling waste or boycotting irresponsible companies, is core to learning for responsibility. We explore the role of apps in learning such responsible practices ‘in the wild,’ outside formal educational environments over a 3-week period. Learners maintained a daily diary in which they reflected on their learning of responsible practices with apps. Through a thematic analysis of 557 app mentions in the diaries, we identified five types of app-agency: cognitive, action, interpersonal, personal development, and (...) material. Findings were interpreted from an actor-network perspective using the lens of ‘translation.’ To understand how apps enabled the learning of responsible practices, we analyzed app agency throughout four moments of translation: problematization, interessement, enrolment, and mobilization. Based on our analysis of how students’ app mentions changed over time, we further theorize learning as a sequence of subtranslations that form the larger translation process: learning as translation(s). Each subtranslation cycle is centered on enrolling a different set of human and nonhuman actors, with their competence, into the network. We contribute to the learning for responsibility field by showcasing how app-enabled learning may create real-life actor networks enacting responsibility, and by priming an actor-network pedagogy for ‘learning in the wild.’ We also contribute to the actor-network learning discussion by conceptualizing heterogeneous human–nonhuman competence and the first processual model of learning as translation(s). Exploring what a scientific metaphysics grounded in biological practices could look like and how it might impact the way we investigate the world around us, the contributors to From Biological Practice to Scientific Metaphysics review and discuss long-held objections to metaphysics by natural scientists. They illuminate how, in order to learn about the world as it truly is, we must look not only at what scientists say but also what they do.

Over the past 20 years or so, a small but growing literature has emerged with the aim of modeling agents who are unaware of certain things. In this paper we compare two different approaches to modeling unawareness: the object-based approach of Board and Chung (Object-based unawareness: theory and applications. University of Minnesota, Mimeo, 2008) and the subjective-state-space approach of Heifetz et al. (J Econ Theory 130: 78-94,2006). In particular, we show that subjectivestate-space models (henceforth HMS structures) can be embedded within (...) object-based models (henceforth OBU structures), demonstrating that the latter are at least as expressive. As long as certain restrictions are imposed on the form of the OBU structure, the embedding can also go the other way. A generalization of HMS structures (relaxing the partitional properties of knowledge) gives us a full converse. (shrink)

Phaenias of Eresus was a member of Aristotle's school, the "Peripatos"or "Lyceum,"and a friend and compatriot of Aristotle's successor, Theophrastus. Phaenias's scholarly interests stretched from strictly philosophical treatises to chronology and the history of philosophy and poetry; to the lives, fortunes, and manners of death of tyrants; to biographical and historical themes and details of famous Athenians; to botanical and zoological issues; and even entertaining, "novelistic"stories and strange reports. This volume includes new scholarship, with translation of source texts for the (...) writings, thought, and influence of Phaenias, as well as essays that take up various areas of his life and work in greater detail. The chapters of Phaenias of Eresus cover a remarkable range of intellectual areas, which is in keeping with the varied interests of the early Peripatetics in general. At the centre of responsible management (RM) learning is the development of managerial competence for ethics, responsibility, and sustainability (ERS). Important contributions have been made from each: the ethics, responsibility, and sustainability disciplines. However, we are yet to integrate these disciplinary contributions into a comprehensive interdisciplinary RM competence framework that corresponds to the interdisciplinary nature of RM challenges. We address this priority in this paper and report on the findings of an integrative structured literature review of 224 management competence articles (...) across the ERS disciplines. Our thematic template analysis has produced an interdisciplinary RM competence framework of three layers of personal, behavioural, and intellectual competences and independent and interdependent competence dimensions. The resulting 3 × 2 competence matrix framework accommodates 33 interdisciplinary ERS competence themes and 90 subthemes in the six competence domains of _being_ and _becoming_, _acting_ and _interacting_, _knowing_ and _thinking_. To the RM discussion, we contribute an interdisciplinary competence framework that enables the development of responsible managers who tackle the inherently interdisciplinary issues of RM. ObjectiveTo apply a socioecological approach to identify risk and protective factors across levels of the “sports-ecosystem,” which are associated with mental health outcomes among athletes in para-sports and non-para sports. A further aim is to determine whether para athletes have unique risks and protective factor profiles compared to non-para athletes.MethodsA cross-sectional, anonymous online-survey was provided to all categorized athletes aged 16 years and older, registered with the Australian Institute of Sport. Mental health outcomes included mental health symptoms, general psychological distress, (...) risky alcohol consumption and eating disorder risk. Risk and protective factors across multiple levels of the socioecological model, including individual, microsystem, exosystem and macrosystem level factors were assessed via self-report.ResultsA total of 427 elite athletes participated in the study. No significant differences in the rates of mental health problems were observed between para and non-para athletes. Both differences and similarities in risk and protective factor profiles were found across the multiple levels of the sports-ecosystem. Weak evidence was also found to support the hypothesis that certain risk factors, including experiencing two or more adverse life events in the past year, sports related concussion, high self-stigma, inadequate social support and low psychological safety conferred a greater risk for poorer mental health outcomes for para athletes in particular.ConclusionRisk factors occurring across various levels of the sports ecosystem, including individual, interpersonal and organizational level risk factors were found to be associated with a range of poorer mental health outcomes. The association between mental ill-health and certain risk factors, particularly those at the individual and microsystem level, appear to be greater for para athletes. These findings have important implications for policy and mental health service provision in elite sports settings, highlighting the need for more nuanced approaches to subpopulations, and the delivery of mental health interventions across all levels of the sports ecosystem. Pioneering work in the 1940s and 1950s suggested that the concept of chunking might be important in many processes of perception, learning and cognition in humans and animals. We summarize here the major sources of evidence for chunking mechanisms, and consider how such mechanisms have been implemented in computational models of the learning process. We distinguish two forms of chunking: the first deliberate, under strategic control, and goal-oriented; the second automatic, continuous, and linked to perceptual processes. Recent work with discrimination-network (...) computational models of long- and short-term memory (EPAM/CHREST) has produced a diverse range of applications of perceptual chunking. We focus on recent successes in verbal learning, expert memory, language acquisition and learning multiple representations, to illustrate the implementation and use of chunking mechanisms within contemporary models of human learning. The influence of age and formal education on the development of moral reasoning in a Spanish sample of students was assessed by using a Spanish translation of Rest's Defining Issues Test. Our results support the hypothesis that moral development is highly related to both variables in our cultural context, although more so with formal education than with age.

The implicit motivational needs for power, achievement, and affiliation are highly relevant in the context of sports. Sport enables people to experience achievement incentives like mastering challenges as well as social incentives such as recognition by teammates. Further, McClelland’s (1986) hypothesized that implicit motives are particularly associated right-hemisphere functions. Therefore, this preregistered study, conducted online, examines motivational needs using a standard picture-story exercise (PSE) and their associations with indicators of laterality, sports participation, and competition in gymnasts (N = 67). Further (...) it explores how implicit motives interact with suitable motivational incentives in the prediction of sports performance. Results partly confirm a link between indictors of cerebral rightward laterality and implicit motives, showing that the implicit affiliation and achievement motives are positively associated with an indicator of emotional-perceptional laterality (chimeric-faces task), but not with an indicator of motor laterality (turning bias). Moreover, the implicit achievement motive was positively correlated with training hours. The implicit affiliation motive was negatively associated with competition level. The presence of achievement incentives (perceived control, failure) and affiliation incentives (training together or alone) did not interact with corresponding motives to predict sports performance. In theories of gravity with a positive cosmological constant, we consider product solutions with flux, of the form (A)dS p ×S q . Most solutions are shown to be perturbatively unstable, including all uncharged dS p ×S q spacetimes. For dimensions greater than four, the stable class includes universes whose entropy exceeds that of de Sitter space, in violation of the conjectured “N-bound.” Hence, if quantum gravity theories with finite-dimensional Hilbert space exist, the specification of a positive cosmological constant will (...) not suffice to characterize the class of spacetimes they describe. The existing literature provides conflicting evidence of whether a collectivistic value orientation is associated with ethical or unethical behavior. To address this confusion, we integrate collectivism theory and research with prior work on social identity, moral boundedness, group morality, and moral identity to develop a model of the double-edged effects of collectivism on employee conduct. We argue that collectivism is morally bounded depending on who the other is, and thus it inhibits employees’ motivation to engage in unethical pro-self behavior, yet (...) strengthens their motivation to engage in unethical pro-organization behavior. We further predict that these effects are mediated by the psychological mechanism of organizational goal commitment and moderated by a person’s strength of moral identity. Results of three studies conducted in China and the United States and involving both field and experimental data offer strong support for our hypotheses. English has plural terms as well as singular terms. But our standard formal languages, e.g., the predicate calculus, feature only singular terms. How can the plural idiom be formalized?‘Changing the subject’ is by far the most common plurals strategy among both philosophers and linguists: a plural term is replaced by a singular term standing for some complex object that ‘contains’ the individuals to which the plural term alludes. For example, one might simply replace ‘A, B imply C’ with ‘{A, B} (...) implies [singular] C’. We uncover a surprising variety of ways to change the subject, of ever‐increasing complexity and ingenuity. Our question is whether any can made to work. (shrink)

Objective: Theory and research suggest that the pursuit of personal goals that do not fit a person's affect-based implicit motives results in impaired emotional well-being, including increased symptoms of depression. The aim of this study was to evaluate an intervention designed to enhance motive-goal congruence and study its impact on well-being. Method: Seventy-four German students (mean age = 22.91, SD = 3.68; 64.9% female) without current psychopathology, randomly allocated to 3 groups: motivational feedback (FB; n = 25; participants learned about (...) the fit between their implicit motives and explicit goals), FB + congruence-enhancement training (CET; n = 22; participants also engaged in exercises to increase the fit between their implicit motives and goals), and a no-intervention control group (n = 27), were administered measures of implicit motives, personal goal commitments, happiness, depressive symptoms, and life satisfaction 3 weeks before (T1) and 6 weeks after (T2) treatment. Results: On two types of congruence measures derived from motive and goal assessments, treated participants showed increases in agentic (power and achievement) congruence, with improvements being most consistent in the FB+CET group. Treated participants also showed a trend-level depressive symptom reduction, but no changes on other well-being measures. Although increases in overall and agentic motivational congruence were associated with increases in affective well-being, treatment-based reduction of depressive symptoms was not mediated by treatment-based agentic congruence changes. Conclusion: These findings document that motivational congruence can be effectively enhanced, that changes in motivational congruence are associated with changes in affective well-being, and they suggest that individuals’ implicit motives should be considered when personal goals are discussed in the therapeutic process. On one hand, Chinese consumers are well known for conspicuous consumption and the adoption of luxury products and named brands. On the other hand, they also have a bad reputation for buying counterfeit products. Their simultaneous preferences for two contrasting types of product present a paradox that has not been addressed in the literature. This study attempts to present an explanation of this paradox by examining the effects of traditional Chinese cultural values and consumer values on consumers’ deontological judgment of (...) pirated CDs and the amount of social benefits they perceive they gain from them. We interviewed 300 Hong Kong Chinese consumers, and found that face consciousness increased materialism and risk aversion, thereby producing a favorable deontological judgment of pirated CDs. Face consciousness also has a direct effect on the amount of social benefits perceived in pirated CDs. Both favorable deontological judgment and perceived social benefits contributed to a strong intention to buy pirated CDs. The results are discussed in a cultural perspective. (shrink)

The International Society of Krishna Consciousness, commonly known as the Hare Krishna Movement, has disseminated a flurry of antievolutionist media since its inception in 1966. Such communications frequently co-opt arguments employed by Christian creationists and Intelligent Design theorists. At the same time, however, there are indications that a scattering of ISKCON publications have articulated relatively ambiguous, less oppositional statements about evolutionary theory. This article reconsiders ISKCON's Darwin-skepticism by appraising recent, largely unexamined Hare Krishna publications, as well as responses to evolutionary (...) theory expressed by ISKCON's founder, A. C. Bhaktivedanta, and his immediate Vaishnava forerunners. The analysis reveals that, although the majority of contemporary ISKCON materials are vehemently opposed to evolution, some leading voices demonstrate less combative, cautiously accommodating stances. These cases are suggestive of complexities in ISKCON's responses to evolution, both past and present, which are not necessarily encapsulated in the terms Vedic creationism or antievolutionism. In our recent article, "Where Does Cumulative Culture Begin? A Plea for a Sociologically Informed Perspective" we commented on a fundamental notion in current approaches to cultural evolution, the “zones of latent solutions”, and proposed a modification of it, namely a social and dynamic interpretation of the latent solutions which were originally introduced within an individualistic framework and as static, genetically fixed entities. This modification seemed, and still seems, relevant to us and, in particular, more adequate for coping with the (...) archaeological record. Bandini et al. rejected our proposition and deemed it unnecessary. In their critique, they focused on: our reservations about an individualistic approach; our objections to the presumption of fully naive individuals; and our demand for an extended consideration of forms of social learning simpler than emulation and imitation. We will briefly reply to their critique in order to clarify some misunderstandings. However, the criticisms also show that we are at an impasse on certain crucial topics, such as the meaning of ZLS and the scope and nature of culture in general. Thus, we consider it necessary to make an additional effort to identify the conceptual roots which are at the very basis of the dissent with Bandini et al. (shrink)

Because no single person or group holds knowledge about all aspects of research, mechanisms are needed to support knowledge exchange and engagement. Expertise in the research setting necessarily includes scientific and methodological expertise, but also expertise gained through the experience of participating in research and/or being a recipient of research outcomes. Engagement is, by its nature, reciprocal and relational: the process of engaging research participants, patients, citizens and others brings them closer to the research but also brings the research closer (...) to them. When translating research into practice, engaging the public and other stakeholders is explicitly intended to make the outcomes of translation relevant to its constituency of users. In practice, engagement faces numerous challenges and is often time-consuming, expensive and ‘thorny’ work. We explore the epistemic and ontological considerations and implications of four common critiques of engagement methodologies that contest: representativeness, communication and articulation, impacts and outcome, and democracy. The ECOUTER methodology addresses problems of representation and epistemic foundationalism using a methodology that asks, “How could it be otherwise?” ECOUTER affords the possibility of engagement where spatial and temporal constraints are present, relying on saturation as a method of ‘keeping open’ the possible considerations that might emerge and including reflexive use of qualitative analytic methods. This paper describes the ECOUTER process, focusing on one worked example and detailing lessons learned from four other pilots. ECOUTER uses mind-mapping techniques to ‘open up’ engagement, iteratively and organically. ECOUTER aims to balance the breadth, accessibility and user-determination of the scope of engagement. An ECOUTER exercise comprises four stages: engagement and knowledge exchange; analysis of mindmap contributions; development of a conceptual schema ; and feedback, refinement and development of recommendations. ECOUTER refuses fixed truths but also refuses a fixed nature. Its promise lies in its flexibility, adaptability and openness. ECOUTER will be formed and re-formed by the needs and creativity of those who use it. (shrink)

Anxiety and stress-related disorders constitute a large global health burden, but are still poorly understood. Prior work has demonstrated clear impacts of stress upon basic cognitive function: biasing attention toward unexpected and potentially threatening information and instantiating a negative affective bias. However, the impact that these changes have on higher-order, executive, decision-making processes is unclear. In this study, we examined the impact of a translational within-subjects stress induction (threat of unpredictable shock) on two well-established executive decision-making biases: the framing effect (...) ( N = 83), and temporal discounting ( N = 36). In both studies, we demonstrate (a) clear subjective effects of stress, and (b) clear executive decision-making biases but (c) no impact of stress on these decision-making biases. Indeed, Bayes factor analyses confirmed substantial preference for decision-making models that did not include stress. We posit that while stress may induce subjective mood change and alter low-level perceptual and action processes ( Robinson et al., 2013c ), some higher-level executive processes remain unperturbed by these impacts. As such, although stress can induce a transient affective biases and altered mood, these need not result in poor financial decision-making. (shrink)

Among theorists associated with the first generation of the Frankfurt School, Herbert Marcuse’s position is singular in that he provides us with an unabashedly affirmative theory of politics as liberatory practice. The article discusses Marcuse’s contribution to political thought by pointing out how, in particular, three aspects remain highly pertinent to contemporary thought: (a) his account of freedom as potentiality, to be actualized in political practice; (b) his conception of the political pre-figuration or pre-enactment of a liberated society; and (c) (...) his rehabilitation of the human faculty of imagination that allows us to overcome the reality principle of the status quo by venturing, qua practice, into the realm of the revolutionary surreal, thereby enlarging the horizon of what is politically imaginable. C. S. Peirce's indictment that "the chief cause of [metaphysics'] backward condition is that its leading professors have been theo (Collected Papers 6:3) falls heavily at my door. For it logians" was out of reflection upon religious experience and its meaning that the present relational metaphysic was conceived. My hope, however, is that its scope is sufficiently wider than its theological origins to justify its appearance as a work in philosophy. Having been nurtured in existential philosophy and having reached some (...) measure of maturity with the wise counsel of Professor Dr. Fritz Buri, of Basel, I came to feel that theology as a modern discipline had reached an impasse owing to its overextended commitments to a subject-object paradigm of thought. Even those theologians who despaired of these ties seemed unable to find an independent alternative idiom for their ideas. A second tension in my thinking resulted from the inordinate neglect by theologians of the natural world. Also, my natural interest in physical understanding seemed unfulfilled within the narrow confines of theology, even of philosophical theology as then practiced. As I turned decisively toward the study of modern physics, and especially of cosmology, a new world seemed to open up to me. After extensive study with prominent astronomers and physicists, it began to dawn on me that the new physics has devised conceptual paradigms of thought which could be generalized into a metaphysical system of universal interest. Two extremely detailed accounts of temporal experience can be found in the work of C. D. Broad. These accounts have been subject to considerable criticism. I argue that, when we look more carefully at Broad’s work, we find that much of this criticism fails to find its target. I show that the objection that ultimately proves troubling for Broad stems from his commitment to two principles: i) the Thin-PSA, and ii) the ‘Overlap’ claim. I use this result to demonstrate that (...) we can learn two extremely important lessons from Broad’s work on temporal experience. -/- The first lesson is that there is a structural problem facing any account that commits to these two principles. This is significant given that a number of recent accounts of temporal experience are so committed. The second lesson is that the problem facing these accounts stems only from commitment to the Thin-PSA and ‘Overlap’, rather than to commitment to a particular conception of how experiences are to be individuated. This, I argue, gives us reason to reject Tye’s recent claim that the problems facing accounts of temporal experience can be dissolved simply by making stipulations about how experiences are to be individuated.
